RETURN AND EXCHANGE POLICY

GENERAL TERMS

 

  1. The seller must deliver the product to the consumer in compliance with the stipulated purpose.
  2. In the case the product presents defect, malfunction or any other reason not in compliance the seller is obliged to respond in regard of it, being the consumer able to carry out any of the following rights: repair, replacement, proper price reduction or reimbursement of paid value.
  3. The repair or replacement should not exceed the 30 (thirty) days deadline.
  4. The rights of proper price reduction and paid value reimbursement may be exercised, as long as, thus it does not reveal impossible or constitute abuse of rights.
  5. The present rights are allocated to the third acquirer of the product, for example, in the case of an offer.
  6. The consumer may exercise its rights within 2 (two) years counting from the product deliverance.
  7. Being the product replaced, the new article benefits of a period of 2 (two) years counting from its delivery.
  8. The 2 (years) deadline is suspended during the period in which the consumer is deprived of the product usage.
  9. To exercise these rights the consumer must communicate the product noncompliance to the seller within the period of 2 (two) months counting from the date of defect or malfunction detection.
  10. The communication must be accompanied by the product delivery date and respective invoice, being filled the RMA (Return Merchandise Authorization), available in aubaci.com website.
  11. The seller reserves the right to inspect the returned product in order to check if there was misuse of it, being that checked out, the product is returned to the consumer, being it held responsible of the payment of all shipping expenses incurred by the seller.
  12. In the return of noncompliance products, and in the case of being send more than one item by the consumer, verifying there is effectively noncompliance in some and not in the others, in the return of the products the shipping expenses should be made in equal parts between seller and consumer.

 

ONLINE PURCHASE

 

  1. In purchases made at aubaci.com the consumer may exercise the right of free settlement, in accordance with the legislation in force.
  2. The communication of the product return must be made in the clients account, in the field “order history”, within 14 (fourteen) days, not being necessary motive invocation.
  3. The seller acknowledges the communication reception to the consumer within 24 (twenty four) hours.
  4. Within 14 (fourteen) days counting from the date of withdraw decision communication, it is mandatory for the seller to refund the consumer of every made payment.
  5. This refund must be made by the same payment method used by the consumer, and since that does not incur any expenses regarding the reimbursement.
  6.  The seller schedules the product pick up in the same address of product deliverance, guarding the right of retaining the reimbursement when the consumer does not deliver the product.
  7. The consumer is responsible of bearing the expenses of the product return.
  8. The consumer may be held responsible by the product depreciation if the product has been handled or inspected beyond common.
  9. The consumer may not withdraw the agreement freely, when dealing with the delivery of products sealed for purposes of health or hygiene, if returned open.
  10. In equal form, the consumer may not withdraw the agreement freely, when dealing with the supply of audio or video recordings originally sealed, if returned with plastic wrapping and/or warranty seal violated.
